The Fine Print - please read!

Fee Notes

For pricing purposes a “page” is one Word document page, 12pt type.

Fees listed are minimums, not caps, and are given as rough estimates, since it is impossible to allow for all variables of a particular job beforehand.

Variables may include research required, complexity of material, abundance or lack of source material, citing,  bibliographies and so on. (For example, a highly technical web page requiring several interviews and a large amount of research, written for an academic audience and containing a full bibliography and citations, would cost considerably more than a simple “overview” page translated from complete, pre-existing source material and written for a general audience.)

Final fees include rewrites, unless other arrangements are made at time of contract.

Some fees are negotiable, or may be offset by bulk rates, royalties from sales resulting from the copy, per use royalties, and other considerations, where appropriate. It never hurts to ask!

Kill Fee

If the client decides to cancel the contract or, after several rewrites done in good faith, the client and I cannot come to a happy agreement on the end product, the client will pay me for services completed to that point or one third of the originally estimated fee, whichever is greater, and I will surrender the current text and materials to the client. The client is then free to do as they wish with the work, as long as my name is not on the resultant end product.

Copyright Notice

In the case of work-for-hire, the copyright transfers to the purchaser of the work upon full payment. (Quick primer in work for hire requirements. Note that work for hire rights assignments must be made in writing.) In all other cases (freelance articles sold to magazines, for example), the copyright remains mine. When in doubt regarding status of the services and products you are purchasing, please ask.

Portfolio Usage

Regardless of copyright assignment, I reserve the right to use any and all work for portfolio and marketing purposes (as samples, clips and so on) and to publish and make use of said materials in any format that such activities require - including but not limited to electronic, print, audio, video and other such methods as shall be developed. All due consideration for and disguise of proprietary and other private information will be taken upon request. Arrangements that preclude or alter this agreement must be made in advance.

In plain English, that means that as a writer I must rely on examples of my past work to acquire future assignments. As a result, I need to be able to show copies of my work to other customers in order to stay in business, and I do this either by making physical copies, uploading them to my onine portfolio and so on.

I will, of course, remove or otherwise redact any proprietary information and other information you don’t want shared around - all you have to do is let me know.

When you hire me, the default agreement is that I can use the finished piece or any drafts in this manner. If you have any conditions or exemptions you want made, you need to negotiate that when we finalize the contract for the assignment. If you don’t say anything, your permission is understood as being given in full.

Please know that I will never use one client’s work as a template for other client’s work (each assignment is guaranteed to be a unique, handcrafted piece of original writing), nor will I use copy that I’ve created for a client for my own personal sales/marketing copy, other than as a sample or clip.

By this I mean that while I may show someone else the killer sales page I wrote for you, so that they know I can do a similar job for them, I won’t just change the products and names sell your sales copy to someone else as their own, nor will I use your killer sales page copy as a sales page for my own or anyone else’s products or services. This applies to any work I do.
